Best of Us — Terms of Service

1. Introduction & Acceptance
Welcome to Best of Us ("the App," "our Service"). Best of Us is owned and operated by Nadal Alyafaie ("we," "us," "our"). By downloading, accessing, or using Best of Us, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
If you do not agree to these Terms, do not use the App.
By creating an account, you confirm that:
You are at least 17 years of age
You have the legal capacity to enter into a binding agreement
You will comply with these Terms at all times
These Terms apply to all users of Best of Us, including both partners in a paired couple account.
2. Description of Service
Best of Us is an AI-powered relationship coaching app designed to help couples communicate better, navigate conflict, and strengthen their relationship over time. The Service allows two partners to each create individual accounts, pair with each other, and interact with an AI relationship coach that is informed by both partners' experiences and inputs.
Important: Best of Us is a coaching and wellness tool only. It is not a licensed mental health service, therapy platform, or crisis intervention service. The AI coach is not a licensed therapist, psychologist, counselor, or medical professional of any kind. Nothing in the App constitutes professional mental health advice, diagnosis, or treatment.
If you or your partner are experiencing a mental health crisis, thoughts of self-harm, or domestic abuse, please contact a qualified professional or emergency services immediately.
3. Account Registration & Pairing
Account Creation Each user must create their own individual account using accurate, truthful information. You may not create an account on behalf of another person or impersonate anyone else. Each person may hold only one account.
Partner Pairing Best of Us is designed for two partners to pair their accounts together. Pairing is initiated by one partner and accepted by the other. Once paired, the AI coach will have access to data from both accounts when generating responses (see Section 5 for details).
Account Security You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately if you become aware of any unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your account.
Accuracy of Information You agree to provide accurate information about yourself and your relationship when using the App. Providing intentionally false or misleading information may result in account termination.
4. Subscriptions & Billing
Plans Best of Us offers the following subscription plans:
Monthly: $14.99 per month
Annual: $149.99 per year
Each subscription covers both partners in a paired couple. Only one partner needs to hold the active subscription for both to access the full Service.
Free Trial New users are eligible for a 7-day free trial upon subscribing for the first time. The free trial is available once per user and is non-transferable. To avoid being charged, you must cancel before the 7-day trial period ends. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan at the applicable rate and your payment method will be charged.
Auto-Renewal Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled. By subscribing, you authorize the applicable app store (Apple App Store or Google Play Store) to charge your payment method on file at the renewal rate.
Cancellation You may cancel your subscription at any time through your device's app store account settings:
iOS: Settings → Apple ID → Subscriptions → Best of Us
Android: Google Play → Subscriptions → Best of Us
Cancellation takes effect at the end of the current billing period. You will retain access to the Service until that date.
Refunds All purchases are processed by Apple or Google and are subject to their respective refund policies. We do not directly process subscription payments and cannot issue refunds. Refund requests must be submitted through the App Store or Google Play.
Failed Payments If a payment fails, your access to the Service may be suspended until the payment is resolved. We are not responsible for any interruption in Service resulting from a failed payment.
5. Couples Pairing & Shared Data
What Your Partner Can See Your partner does not have direct access to your individual conversations, messages, or profile data within the App. You cannot view or modify your partner's account, and they cannot view or modify yours.
How the AI Coach Uses Both Partners' Data When the AI coach generates a response to either partner, it may draw upon information shared by both partners — including messages, questionnaire responses, and relationship history — in order to provide contextually informed coaching. This means that while your partner cannot read your messages directly, the insights you share with the AI coach may inform the advice and responses your partner receives, and vice versa.
By using Best of Us and pairing with a partner, you acknowledge and consent to this data model.
What Happens When a Partner Unpairs or Deletes Their Account If either partner unpairs or deletes their account, the remaining partner's account will be returned to an unpaired state. Shared relationship coaching history may no longer be fully accessible. We are not liable for any loss of coaching continuity resulting from a partner's decision to unpair or delete their account.
We recommend both partners discuss the decision to leave the App before one partner takes action.
6. Acceptable Use Policy
You agree not to use Best of Us to:
Harass, threaten, or harm your partner or any other person
Provide intentionally false or misleading information to manipulate AI coaching responses
Attempt to circumvent, reverse-engineer, or exploit the App or its AI systems
Use the App for any unlawful purpose
Impersonate another person or misrepresent your identity
Upload or transmit harmful, offensive, or illegal content
Attempt to access another user's account without authorization
Use the App in any way that could damage, overload, or impair the Service
Violation of this policy may result in immediate account suspension or termination.
7. AI Coaching Disclaimer
Not Professional Therapy The AI relationship coach provided by Best of Us is not a substitute for professional therapy, counseling, psychiatric care, or any other licensed mental health service. Our AI coach is not a licensed professional and is not qualified to diagnose mental health conditions, prescribe treatment, or provide crisis intervention.
No Guaranteed Outcomes We make no representations or warranties that using Best of Us will improve your relationship, prevent separation or divorce, or produce any specific outcome. Relationship outcomes depend on many factors outside our control.
AI Limitations The AI coach may occasionally produce responses that are inaccurate, incomplete, or not applicable to your specific situation. You should use your own judgment when evaluating any coaching advice and should not make significant life decisions based solely on AI-generated content.
Crisis Situations If you or your partner are experiencing domestic violence, abuse, thoughts of self-harm or suicide, or any other crisis, please contact emergency services or a qualified mental health professional immediately. The App is not equipped to handle emergency situations.
8. Intellectual Property
Our Content All content, features, functionality, design, and intellectual property within Best of Us — including but not limited to the app interface, AI systems, mascot character, branding, and written content — are owned by Nadal Alyafaie and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the App without express written permission.
Your Content You retain ownership of the content you submit to the App (such as your messages and questionnaire responses). By submitting content to Best of Us, you grant us a limited, non-exclusive, royalty-free license to use that content solely for the purpose of providing and improving the Service.
Feedback If you submit feedback, suggestions, or ideas about the App, you grant us the right to use that feedback without compensation or attribution to you.
9. Account Deletion & Termination
Deleting Your Account You may delete your account at any time from within the App via Settings → Account → Delete Account. Upon deletion, your profile, messages, questionnaire responses, and associated data will be permanently removed from our systems.
Effect on Your Partner If you delete your account, your partner's account will be unlinked and returned to an unpaired state. Your partner will be notified that the pairing has ended.
Subscriptions Are Not Automatically Cancelled Deleting your account does not automatically cancel your subscription. You must cancel your subscription separately through your app store account settings. If you do not cancel, you will continue to be charged at your renewal rate. Please see Section 4 for cancellation instructions.
Termination by Best of Us We reserve the right to suspend or terminate your account at any time, with or without notice, if we determine that you have violated these Terms, engaged in harmful behavior, or if we cease to operate the Service. Upon termination, your right to access the App will immediately end.
10. Disclaimers & Limitation of Liability
No Warranty Best of Us is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, accuracy, or availability of the Service.
Limitation of Liability To the fullest extent permitted by law, Nadal Alyafaie shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App — including but not limited to emotional distress, relationship outcomes, data loss, or interruption of Service. Our total liability to you for any claim arising from your use of Best of Us shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
Emotional Distress You acknowledge that relationship coaching may involve discussions of sensitive personal topics. We are not liable for any emotional distress resulting from your use of the App or from AI-generated coaching content.
11. Dispute Resolution & Governing Law
Governing Law These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.
Informal Resolution Before initiating any formal dispute, you agree to contact us at the email listed in Section 13 and provide us with a written description of the dispute. We will attempt to resolve the issue informally within 30 days.
Arbitration If informal resolution fails, any dispute arising out of or relating to these Terms or your use of Best of Us shall be resolved by binding individual arbitration administered under the rules of the American Arbitration Association (AAA), conducted in Fresno, California.
Class Action Waiver You agree that any dispute will be resolved on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration against Nadal Alyafaie or Best of Us.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this document. For significant changes, we will notify you via in-app notification or email. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the App and delete your account.
